Motor Vehicle Accidents
If you have been involved in a motor vehicle accident and you do not have insurance that covers the type of damage that resulted, you may become involved in a dispute with the other party involved in the accident.
They may expect you to pay for the damage caused to their vehicle, or you may need to try and get them to pay for the damage to your vehicle. The question of who is legally responsible for paying for damage will depend on the circumstances of the accident and who was at fault.
Unless you are prepared to admit that the accident was your fault and pay for all the repairs, you should be careful not to make any admissions as to fault. You should obtain at least two quotations for repairs to your vehicle, and write down as accurately as possible the circumstances of the accident, including a diagram if possible. You should bring these documents with you to your appointment.
Monash-Oakleigh Legal Service can help you negotiate with the other party involved in the accident or their insurer. We can assist you to draft a letter of demand if you are seeking payment from them, or respond to a letter of demand if they are seeking payment from you. We can also provide advice about the options available to you and the appropriate actions to take during the various stages of your matter and help you prepare to present you case if the matter ends up in court.
